February 13, 2006

The Tallapoosa County Commission held its regular meeting February 13, 2006 at the Courthouse in Dadeville, AL at 9:00 a.m.  Tallapoosa Publishers was present.   

Chairman Thweatt called the meeting to order at 9:00 a.m.

Public Comments from Citizens:

Communication Contract for Town of Jackson's Gap Police Department: No Show 

Peter Mastin addressed the Commission requesting $20,000 in matching funds for an EMS truck.

Union Volunteer Fire Department: No Show

Public Comments from Elected Officials:

Chairman Thweatt called the roll. All commissioners were present.

Commissioner Shaw gave the invocation.

Chairman Thweatt led the Pledge of Allegiance.

Consent Agenda:

Commissioner Shaw made a motion to approve the January 6, 2006 Commission minutes. Commissioner Oliver seconded the motion. The motion passed unanimously. Attachment

Commissioner Allen made a motion to approve the purchase orders for the Highway department and warrants for all funds. Commissioner Shaw seconded the motion. The motion passed unanimously. Attachment

Commissioner Shaw made a motion to approve the levies for Ad Valorem Tax for Tallapoosa County. Commissioner Oliver seconded the motion. The motion passed unanimously. 

Commissioner Shaw made a motion to approve the 2005-2006 County Levies for Alcoholic Beverages. Commissioner Coley seconded the motion. The motion passed unanimously.  Attachment

Commissioner Allen made a motion to approve the naming of Old Highway 280 to Old 280 Road. Commissioner Coley seconded the motion. The motion passed unanimously. 

Commissioner Allen made a motion to approve the transfer of Retail Beer (Off Premises Only) for E&J One Stop. Commissioner Coley seconded the motion. The motion passed unanimously. Attachment

Commissioner Allen made a motion to approve the transfer of Restaurant Retail Liquor License for The Cove at Blue Creek. Commissioner Coley seconded the motion. The motion passed unanimously. Attachment

Commissioner Allen made a motion to approve JM Wood Auction Company, Inc. for Auction Services. Commissioner Oliver seconded the motion. The motion passed unanimously. Attachment

Commissioner Shaw made a motion to allow Jackson's Gap to participate in the Tallapoosa County Building Code Inspections. Commissioner Coley seconded the motion. The motion passed unanimously.  Attachment

Commissioner Shaw made a motion to approve Manoy Heights Subdivision Plat. Commissioner Oliver seconded the motion. The motion passed unanimously. Attachment

Commissioner Allen made a motion to hire a temporary Secretary for the Sheriff's office. Commissioner Oliver seconded the motion. The motion passed unanimously.  Attachment

Commissioner Allen made a motion to seek bids for a telephone system for the Sheriff's department. Commissioner Shaw seconded the motion. The motion passed unanimously. Attachment

Commissioner Shaw made a motion to seek bids for Sheriff's vehicles. Commissioner Coley seconded the motion. The motion passed unanimously.  Attachment

Commissioner Shaw made a motion to approve the decrease in mileage rate to 44.5 per mile. Commissioner Allen seconded the motion. The motion passed unanimously.  Attachment

Commissioner Shaw made a motion to seek bids for a van to transport inmates. Commissioner Coley seconded the motion. The motion passed with a vote of 4-0 with an abstention from Commissioner Allen. Attachment

Commissioner Allen made a motion to approve the budget for CDBG Project CY-CE-PF-05-039 for Wall Street Nutrition Center. Commissioner Coley seconded the motion. The motion passed with a 3-1 vote. Commissioner Allen, Commissioner Thweatt and Commissioner Oliver voted yes. Commissioner Shaw voted no. Commissioner Coley abstained from voting.  Attachment

Commissioner Coley made a motion to apply for an ADECA grant for Sheriff Funding. Commissioner Oliver seconded the motion. The motion passed unanimously.  Attachment

Commissioner Oliver made a motion to apply for an Industrial Access Grant for Welborn Cabinets. Commissioner Allen seconded the motion. The motion passed unanimously.

Commissioner Allen made a motion to approve an increase the Coroner and Deputy Coroner salary. Commissioner Oliver seconded the motion. The motion passed unanimously.  Attachment

Commissioner Allen made a motion to approve the following transfer of Sick Leave:
22.13 hours from Timmy Anderson to Clint Harper
40 hours from Tim Adams to Sam Fitten
10 hours from John Williams to Sam Fitten
Commissioner Coley seconded the motion. The motion passed unanimously. Attachment

Commissioner Coley made a motion to hire a temporary employee for the Probate Office. Commissioner Allen seconded the motion. The motion passed unanimously.

Old Business:

Commissioner Oliver made a motion to divide the remaining Hospital Fund money between the Volunteer Fire Departments. Commissioner Coley seconded the motion. The motion passed with a 3-2 vote. Commissioner Oliver, Commissioner Shaw, and Commissioner Coley voted yes. Commissioner Allen and Commissioner Thweatt voted no.

Commissioner Allen made a motion to donate the same amount the Union and Reeltown Volunteer Fore Departments as well. The motion died from lack of a second.

Commissioner Coley made a motion to approve the budget amendment for the Hospital Board Fund. Commissioner Oliver seconded the motion. The motion passed with a 3-2 vote. Commissioner Coley, Commissioner Shaw, and Commissioner Oliver voted yes. Commissioner Allen and Commissioner Thweatt voted no.

 

New Business:

Discussion Items by Commissioners:

Commissioner Thweatt addressed the Commission concerning placing political signs on the County Right of Way. Commissioner Thweatt stated that under the current law political signs can be removed from the right of way. Commissioner Thweatt stated that he will remove political signs in his district. Commissioner Coley stated that he believes that it should be a county issue instead of district issue. Commissioner Coley stated that everyone has the right to campaign and the freedom of speech.

Commissioner Thweatt made a motion to enter executive session. Commissioner Coley seconded the motion. The motion passed unanimously. Commissioner Coley made a motion to exit executive session. Commissioner Shaw seconded the motion. The motion passed unanimously.

Announcements:

Commissioner Thweatt stated that the Courthouse will be closed Monday February 20th in honor of President's Day.

Commissioner Coley made a motion to adjourn. Commissioner Oliver seconded the motion. The motion passed unanimously.
