Regular Meeting
July 11, 2005

The Tallapoosa County Commission held its regular meeting July 11, 2005 at the Courthouse in Dadeville, AL at 9:00 a.m. All commissioners were present. Tallapoosa Publishers was also present.

Chairman Oliver called the meeting to order.

Commissioner Shaw gave the invocation and led the Pledge of Allegiance.

Commissioner Allen made a motion to approve the June 13th and June 24th minutes. Commissioner Shaw seconded the motion. The motion passed unanimously. Attachment

Commissioner Shaw made a motion to approve the warrants. Commissioner Allen seconded the motion. The motion passed unanimously. Attachment

Danny Lloyd with the Volunteer Fire Department Association addressed the Commission. Lloyd requested that the Commission adopt a policy to continue the $5000 volunteer fire department funding as an appropriation. Lloyd also requested that the Commission adopt a policy giving the volunteer fire departments access to any county vehicles declared as surplus. Lloyd asked when the budget requests need to be submitted. Lloyd asked if the Commission has received any information regarding the letter sent to the Attorney General's Office. County Attorney, Thomas Radney, stated that they should have a response by the next Commission meeting. Attachment

Al Blythe stated that he would like to wait until after the discussion for Item Q before making any remarks.

Don Westbrook: No Show

EMA Director, Joe Paul Boone, addressed the Commission concerning Hurricane Dennis and Flood Insurance. Boone informed the Commission of numerous shelters open to the public for protection against Hurricane Dennis. Boone stated that Trinity Baptist Church had 58 people in the shelter. Jackson's Gap Baptist Church had 63 people in the shelter. Boone stated that everyone worked well together during the storm. Commissioner Shaw thanked Boone and Janice Phillips for the hours put in during the storm. Commissioner Allen stated that the Commission has studied Flood Insurance for years, and that bringing in a Building Inspector was an advantage for Flood Insurance.

Commissioner Allen made a motion to approve the Resolution and Order authorizing and providing for the Issuance of General Obligation Warrants dated July 1, 2005. Commissioner Thweatt seconded the motion. The motion passed with a vote of 3-2. Commissioner Allen, Commissioner Thweatt, and Chairman Oliver voted yes. Commissioner Shaw and Commissioner Coley voted no. Attachment

County Administrator, Annette McGrady, addressed the Commissioner concerning the Sheriff's department water vessel bid. McGrady stated that the only bid received was from PSI for $58,140.25. Sheriff Abbett stated that the boat is a 21 foot boat, and that the County has never had a new boat. Commissioner Allen made a motion to award bid # 001-FY2005-39 to PSI. Commissioner Coley seconded the motion. The motion passed with a 4-0 vote with on abstention from Commissioner Thweatt. Attachment

Commissioner Coley made a motion to seek bids for a 15 ton heat pump for the Tallapoosa County Courthouse. Commissioner Thweatt seconded the motion. The motion passed unanimously.

Commissioner Thweatt made a motion to award bid # 001-FY2005-41 (heat pump) to Sunshine Heating & Air. Commissioner Shaw seconded the motion. The motion passed unanimously. Commissioner Allen directed McGrady to give a copy of all of the bids to The Outlook. Attachment

Commissioner Thweatt made a motion to seek bids for surface treatment on Elder Road (111-FY2005-42). Commissioner Allen seconded the motion. The motion passed unanimously. Attachment

Commissioner Thweatt made a motion to seek bids for tri-axle dump trucks. Commissioner Shaw seconded the motion. The motion passed unanimously.
Commissioner Allen stated that he wants a copy of all the bids to be sent to The Outlook. Attachment

Commissioner Allen made a motion to hire Willie Jo Hutchins as an Equipment Operator III. Commissioner Thweatt seconded the motion. The motion passed unanimously.

Commissioner Shaw made a motion to award the bid for construction materials for the C.J. Coley Courthouse Annex project (bid # 001-FY2005-40) to Lake Martin Building Supply. Commissioner Thweatt seconded the motion. The motion passed unanimously. Attachment

Commissioner Allen wanted to know from what fund the Building Inspector Clerk is being paid. Administrator McGrady stated that she is being paid from the Gasoline Tax Fund. Commissioner Allen stated that is illegal to pay her from that fund. Commissioner Allen made a motion to pay her from the General Fund and to reimburse the Gasoline Tax Fund retro-active from the time she transferred departments. Commissioner Thweatt seconded the motion. The motion passed unanimously.

County Engineer David Moore stated that Sign Truck Operator, Richard Pettit, is retiring in December. Moore stated that he believes the County needs to hire someone to replace him now, so that Pettit can train the person. Moore suggested that the County hire Clyde Harper. Chairman Oliver made a motion to hire Clyde Harper as the Sign Truck Operator. Commissioner Allen seconded the motion. The motion passed unanimously.

Commissioner Shaw made a motion to approve the final plat for Cherokee Cabins. Commissioner Thweatt seconded the motion. The motion passed unanimously. Attachment

Commissioner Allen made a motion to hire a temporary assistant for the Highway Department. Commissioner Thweatt seconded the motion. The motion passed unanimously.

Commissioner Allen made a motion to obtain Right-Of-Way on Trimble Road, Ridge Road, Thornton Road, Campbell Road, and Barnsville Loop. Commissioner Thweatt seconded the motion. The motion passed unanimously.

Commissioner Allen made a motion to approve the following transfer of time:
Ava Mason- 72 hours sick time to Toneicka Wyckoff
Patricia Guthrie- 8 hours vacation to Toneicka Wyckoff
Carolyn Moss- 5 hours sick time to Toneicka Wyckoff
Orlando Jones- 5 hours vacation to Toneicka Wyckoff
Lamarquis Daniel- 8 hours sick time to Toneicka Wyckoff
Wade Crowe- 40 hours sick time to Patricia Collum
Gwen Pinkston- 100 hours sick to Mary Ann Adams
Ava Mason- 15 hours sick to Bertha Shaw
Commissioner Thweatt seconded the motion. Commissioner Coley asked if the transfers meet the requirements of the personnel policy. McGrady answered yes. The motion passed unanimously. Attachment

Commissioner Thweatt made a motion for plans to redistrict as soon as possible. Commissioner Allen stated that he does not have a problem with the motion, but redistricting is not his problem. He is in compliance with the law and does not need to redistrict. Commissioner Shaw stated that he is also in compliance. Commissioner Coley stated that he does not have a problem with the motion, but that the Commission needs to have some kind of public meeting before September. Commissioner Coley seconded the motion. The motion passed unanimously.

Commissioner Thweatt made a motion to enter into an Executive Session. Commissioner Allen seconded the motion. The motion passed unanimously.

Commissioner Thweatt made a motion to return to a Regular Session. Commissioner Allen seconded the motion. The motion passed unanimously.

Commissioner Thweatt made a motion to award Patricia Collum 80 hours sick time from Nikki Holloway. Commissioner Allen seconded the motion. The motion passed with a 3-2 vote. Commissioners Oliver, Allen, and Thweatt voted yes. Commissioners Shaw and Coley voted no.

McGrady stated that retired Probate Judge Eldon Sharpe passed away on Saturday.

Commissioner Allen made a motion to adjourn the meeting. Commissioner Thweatt seconded the motion. The motion passed unanimously. Meeting adjourned at 9:50.
