Regular Term Meeting
June 23, 2003

The Tallapoosa County Commission held a special called meeting June 23, 2003, at the Courthouse in Dadeville, Alabama at 9:00 a.m. Commissioners present were Charles Shaw, Dylan Oliver, William Thweatt, and Johnny Allen. Commissioner Thomas L. Coley Jr. was absent.

Chairman Johnny Allen called the meeting to order. Commissioner Shaw gave the invocation and led the Pledge of Allegiance.

The Commission opened bids for Campground Road. The Commission received bids from McCartney Construction Co., Dunn Construction Co., and East River Construction Co. Commissioner Oliver made a motion to award the bid to East River Construction Co. Commissioner Thweatt seconded the motion. The motion passed unanimously. Bids attached.

The Commission opened bids for Point Cloxson Circle. The Commission received bids from McCartney Construction Co., Dunn Construction Co., and East River Construction Co. Commissioner Oliver made a motion to table the bids. Commissioner Thweatt seconded. The motion passed unanimously. Bids attached.

County Attorney, E. Paul Jones reported to the Commission on Henry Knight vs. Tallapoosa County. The Insurance Fund negotiated a settlement for $95,000. A controversy arose as to whether the settlement was intended to include his medical expenses. Jones convinced Kenneth Ingram that the settlement was expected to cover at least a portion of the medical expenses. Ingram informed Jones that he would put in escrow all of the settlement money, except his attorney fees, until a decision was made. Buddy Sharpless called Meadowbrook and told them to pay the $95,000 and that the County would pay the medical expenses. Jones feels like this was a bad decision. No one in the county knew that a settlement was being made. Chairman Allen stated that he believed that the Board of Education should pay all of the money. He stated that this accident would not have happened if Knight were not working on a Board of Education project. Chairman Allen stated that if Meadowbrook was going to pay the $95,000, that the Board of Education should pay the medical expenses. Jones had to leave the commission meeting for a previously scheduled meeting in Montgomery. No motion was made.

The Commission discussed the voting place at Hillabee. The Commission decided to put Dan Cook in charge of getting prices for a portable classroom.

Chairman Allen suggested that the Commission shut down the Recycle Department; and put Mike Lucas in charge of the Building Inspector Department. Commissioner Shaw mentioned that Mike Lucas might not be qualified to be the Building Inspector. No motion was made.

Chairman Allen made a motion to hire a part-time employee while one full-time employee is having surgery. Commissioner Thweatt seconded the motion. The motion passed unanimously.

Commissioner Oliver requested permission to hire a part-time employee. Commissioner Thweatt made a motion to grant permission to Commissioner Oliver. Commissioner Shaw seconded the motion. The motion passed unanimously.

Commissioner Thweatt made a motion to adjourn. Commissioner Shaw seconded the motion. The motion passed unanimously.
