January 10, 2005

The Tallapoosa County Commission held its regular meeting January 10, 2005 at the Courthouse in Dadeville, AL at 9:30 a.m. All commissioners were present except District 5 Commissioner, Johnny Allen.

Chairman Shaw called the meeting to order.

Chairman Shaw gave the invocation and led the Pledge of Allegiance.

Commissioner Thweatt made a motion to approve the December 13 minutes after corrections have been made. Commissioner Oliver seconded the motion. The motion passed unanimously.

Commissioner Coley made a motion to approve the warrants. Commissioner Oliver seconded the motion. The motion passed unanimously.

Revenue Commissioner, Linda Harris, presented a proclamation honoring Billy Ray Wall. Attachment

County Attorney, E. Paul Jones presented a resolution for Pre-trial Diversion. Commissioner Coley made a motion t o approve the resolution for the District Attorney's Office. Commissioner Oliver seconded the motion. The motion passed unanimously. Jones also stated that this meeting would be his last as County Attorney. Jones stated that his swearing in ceremony for District Attorney would be Monday January 17, 2005 at 4:00 p.m. Attachment

Commissioner Coley made a motion to award bid number 001-FY2005-20 for a Modular Lighting System to United Rentals. Commissioner Oliver seconded the motion. The motion passed unanimously. Attachment

Commissioner Coley made a motion to award bid number 001-FY2005-21 for a new Security System for the Tallapoosa County Courthouse to Harris Security Systems. Commissioner Oliver seconded the motion. The motion passed unanimously. Attachment

Commissioner Coley made a motion to reject the bids for a 42" Color Scanner for the Probate Office. Commissioner Oliver seconded the motion. The motion passed unanimously. Attachment

Commissioner Coley made a motion to award bid number 001-FY2005-22 for a Video Surveillance System for the Water Filtration Plant to Harris Security Systems. Commissioner Oliver seconded the motion. The motion passed unanimously. Attachment

Commissioner Coley made a motion to seek bids for additional equipment for the security system for the Tallapoosa County Courthouse. Commissioner Oliver seconded the motion. The motion passed unanimously.

Commissioner Coley made a motion to appoint a citizen to the East Alabama Regional Planning Commission. Commissioner Thweatt seconded the motion. The motion passed unanimously.

Commissioner Thweatt made a motion to table the bids for a tri-axle dump truck and truck tractors. Commissioner Coley seconded the motion. The motion passed unanimously.

Commissioner Coley made a motion to approve the Medical Physician Agreement with Dr. Robert Schuster. Commissioner Oliver seconded the motion. The motion passed unanimously. Attachment

Commissioner Thweatt made a motion to approve the resolution authorizing the dissolution of the Tallapoosa County Hospital Board. Commissioner Oliver seconded the motion. The motion passed unanimously. Attachment

Commissioner Thweatt made a motion to leave the mileage rate at 37.5 cents per mile. The motion died for lack of a second. Commissioner Coley made a motion to raise the mileage rate to 40.5 cents per mile as approved by the State of Alabama effective January 1, 2005. The motion died for lack of a second. The rate stays the same. Attachment

Commissioner Coley made a motion to seek bids for 3 cars for the Sheriff's Department. Commissioner Thweatt seconded the motion. The motion passed unanimously.

Commissioner Thweatt made a motion to hire an employee at a rate of $7.50 per hour on a three-month basis for district 3. Chairman Shaw seconded the motion. The motion passed with a 3-0 vote with an abstention from Commissioner Coley. Commissioner Coley wanted to transfer an employee from another district to district 3. County Engineer, David Moore, stated that all part-time employees have been laid off.

Commissioner Thweatt addressed the issue of the Unit System. Thweatt stated that because the law was not voted on statewide that he believes that it is not constitutional. No action was taken.

EMA Director, Joe Paul Boone, introduced Janice Phillips as the new EMA administrative assistant.

Revenue Commissioner, Linda Harris, stated that she would like to see the mileage rate raised to 40.5 cents per mile. Harris stated that many appraisers are required to drive for their jobs. Harris stated that most of the counties will adopt the increase, resulting in her appraisers not being reimbursed on an even scale. Commissioner Coley made a motion to raise the mileage rate to 40.5 cents per mile. Commissioner Oliver seconded the motion. The motion passed by a 3-1 vote. Chairman Shaw, Commissioner Coley, and Commissioner Oliver voted yes. Commissioner Thweatt voted no.

Maintenance Supervisor, Mike Lucas, addressed the Commission. Lucas stated that while the Maintenance Department was patching the roof for the Historical Society that the back wall fell out. Lucas stated that the wall was rotten. Lucas requested that the Commission donate the cement blocks from the Russell R&D Building to the Historical Society. Commissioner Coley made a motion to donate the cement blocks to the Historical Society. Commissioner Thweatt seconded the motion. The motion passed unanimously.

Commissioner Coley requested that everyone participate in the Martin Luther King Jr. holiday.

Chairman Shaw stated that the Tallapoosa County Courthouse would close on January 17, 2005 for the Martin Luther King Jr. holiday.

Commissioner Thweatt made a motion to adjourn. Commissioner Oliver seconded the motion. The motion passed unanimously.
